Australia, July 7 -- New South Wales Land and Environment Court issued text of the following judgement on June 6:

1. On 29 August 2024 the Tribunal determined that Muruga Balaji Kandasamy Mohan ("the Respondent") was guilty of unsatisfactory professional conduct pursuant to s 139B(1)(l) of the Health Practitioner Regulation National Law (NSW) ("the National Law") and that he was guilty of professional misconduct pursuant to s 139E of the National Law (Health Care Complaints Commission v Mohan [2024] NSWCATOD 134).

2. The proceedings were then adjourned to consider what protective orders should be made flowing from those conclusions.

3. These reasons assume familiarity with the facts and circumstances of the complaints that led to the making of those findings and of the Tribunal's reasons for decision, however it is useful to briefly refer to the facts to give context to these reasons.

4. In 1995 the Respondent obtained his Bachelor of Medicine and Surgery from Madurai Medical College in India. He completed his internship between 1996 and 1997 at the Government Rajaji Hospital, Madurai. While in India, the Respondent worked as a resident in hospitals in Madurai and in 2001 commenced work as a senior resident in accident and emergency at Apollo Multispeciality Hospitals in Mysore and Goa in India. In 2005 the Respondent worked in Dhaka, Bangladesh for the same hospital group.

5. He was first registered as a medical practitioner in NSW on 1 June 2006. On 1 November 2009 the Respondent commenced working as an Intensive Care Unit Medical Officer at Strathfield Private Hospital. He ceased that employment on 17 September 2022.

6. The Respondent was a part owner of the Northwest Medical Centre in NSW until November 2024 and of the Churchill Family Practice in Victoria until May 2025. He now has no financial interests in any general practices. The Respondent is presently working one day per week in a general practice in Sydney.

7. The Complaints brought by the Health Care Complaints Commission ("the Commission") concerned the Respondent's conduct towards three female complainants (Persons A, B and C) who worked with him on night shifts at Strathfield Private Hospital.
